RELEASE, WAIVER AND INDEMNITY.
IN CONSIDERATION of the acceptance of my application and permission to participate as a Volunteer in the PRIDE & REMEMBRANCE RUN on June 29, 2024, I, for myself, my heirs, executors, administrators, successors and assigns, HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE the City of Toronto, the Toronto Police Service, the Toronto Police Services Board, the Members of the Toronto Police Service Auxiliary Program, the Chief of Police, the Toronto Transit Commission, Athletics Ontario, the Ontario Track and Field Association, Canada Running Series, the Pride and Remembrance Association, the Pride and Remembrance Foundation, the members, directors and officers of the Pride and Remembrance Association and the members, directors and officers of the Pride and Remembrance Foundation, the members and staff of Pride Toronto, and all other associations, sanctioning bodies and sponsoring companies, and all their respective agents, officials, servants, contractors, representatives, elected and appointed officials, successors and assigns OF AND FROM ALL claims, demands, damages, costs, expenses, actions and causes of action, whether in law or equity, in respect of death, injury, loss or damage to my person or property HOWSOEVER CAUSED, arising or to arise by reason of my participation in the said event, whether as a spectator, participant, competitor or otherwise, whether prior to, during or subsequent to the event, AND NOTWITHSTANDING that same may have been contributed to, or occasioned by, the negligence of any of the aforesaid. I FURTHER HEREBY UNDERTAKE to HOLD AND SAVE HARMLESS and AGREE TO INDEMNIFY all of the aforesaid from and against any and all liability howsoever incurred by any or all of them as a result of, or in any way connected with, my participation in the said event as Volunteer.
I HEREBY CONSENT to the use, reproduction, editing and/or broadcast by the Pride and Remembrance Association and/or of its service contractors or agents of any and all photographs, video, audio recordings and comments gathered during any aspect of the Pride & Remembrance Run, and to allow the Pride and Remembrance Association to use said recordings in any future print or electronic publishing. All positives, prints, audio and video recordings, and any other digital media taken by and/or on behalf of the Pride & Remembrance Run shall constitute the property of the Pride and Remembrance Association and/or the photographer/digital media recorder/writer. I RELEASE any photographers/videographers/writers from all claims and liabilities relating to said photographs, video, audio recordings and written comments, and waive any rights of compensation or ownership thereto.
I WARRANT that I am physically fit to participate in this event as Volunteer. If volunteer is under 18 years of age, parent or guardian must agree to the waiver. BY SUBMITTING THIS ENTRY, I ACKNOWLEDGE HAVING READ, UNDERSTOOD AND AGREED TO THE ABOVE WAIVER, RELEASE AND INDEMNITY.
Waiver of Liability and Indemnity Agreement
I understand that participating in physical fitness events is a potentially hazardous activity. I agree not to participate unless I am medically able and properly prepared. I attest that I am physically fit and sufficiently trained for the completion of the Event as Volunteer. "Event" shall include, but is not limited to, the Pride & Remembrance Run and all activities, events or services in any way provided, organized, sponsored or authorized by the Event Organizers. On my own behalf, and on behalf of any minors or third parties for whom I am registering, I agree that (a) we will abide by any decision of an Event official concerning our ability to participate safely; (b) we will assume any and all risks associated with the Event; including but not limited to, falls, contact with other persons or objects, the effects of weather, traffic and course conditions; (c) we hereby consent to permit, and accept responsibility for emergency treatment in the event of injury or illness; and (d) we understand that if the Event cannot be held as scheduled, we may not be entitled to a refund of any money paid.
We further agree that (a) the Event Organizers shall not be liable for any personal injury, death or property loss, and we release the Event Organizers and waive all claims with respect thereto, and (b) to hold harmless and indemnify the Event Organizers, from any and all liability from any property damage or personal injury to any third party resulting from my participation as Volunteer in the Event. We grant permission to Event Organizers to use or authorize others to use our personal information, including but not limited to, any photographs, images or documentation of our participation in this Event or related activities without remuneration being provided to us. We further grant permission to Event Organizers to share my email address with service contractors who I acknowledge may contact me about photographs that may be taken of me at the event.
I represent and warrant (a) I am over eighteen (18) years of age, and that if I am registering a minor, that I am the parent or guardian of such minor; (b) if I am registering third parties, I have been duly authorized to act on behalf of such parties; and (c) that the terms of this registration shall apply equally to me, any minor and to any third parties for whom I am acting. The participation in the Event by a third party shall be their confirmation that I was acting as their agent.
I acknowledge and agree to the following:
(a) I acknowledge the highly contagious nature of COVID-19 and I voluntarily assume the risk that I could be exposed to or infected by COVID-19 by participating in the Event. Being exposed to or infected by COVID-19 may particularly lead to injuries, diseases or other illnesses;
(b) I agree to comply with all health and safety guidelines and requirements for the Event which may be implemented by the City of Toronto, or the Pride and Remembrance Association, or both;
(c) I acknowledge and accept that the Event may be cancelled and/or rescheduled as a result of the ongoing impact of COVID-19; and
(d) I confirm that the Pride and Remembrance Association may disclose and/or provide my participant information to public health authorities for the purposes of contact tracing, if necessary.
