GENERAL RELEASE AND INDEMNITY
IN CONSIDERATION of the Sporting Life 10K accepting my entry and the permission to participate as an volunteer in the Sporting Life 10K (hereinafter the "Event”), and any other 2025 Sporting Life 10K activities, either in person or virtually, that take place prior to, during or after the Event (collectively, the “Activities”) I, THE BELOW UNDERSIGNED, INTENDING TO BE LEGALLY BOUND, FOR MYSELF, MY HEIRS, MY EXECUTORS, ADMINISTRATORS, SUCCESSORS AND ASSIGNS, HEREBY AGREE, ACKNOWLEDGE AND CONFIRM AS FOLLOWS:
1. I hereby agree that I freely accept and assume all risks, dangers and hazards associated with my participating in the Activities. I am aware that participating in the Activities involves risk, dangers and hazards that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious injury, including permanent disability, death, illness, disease, or property loss. The risk, dangers and hazards may be caused by my own actions or inactions, the condition in which the Activities take place, or the negligence, breach of contract or breach of a legal duty of care of other parties, including the Releasees (as defined below). I understand that the risks may be relative to my own state of fitness and health (including, physical, mental and emotional), and to the awareness, care and skill with which I conduct myself.
2. I am participating voluntarily in the Activities. In consideration of that participation, I hereby acknowledge that the Releasees may fail to safeguard me from the risks, dangers and hazards of the Activities, some of which are listed below. The risks, dangers and hazards include, but are not limited to physical exertion, overexertion, dehydration, fatigue, lack of fitness or conditioning, traumatic injury, sprains and fractures; my failure act safely or within my own abilities, including my failure to use or operate the equipment (of my own choosing) within my own abilities; negligent advice regarding the Activities; my conduct and the conduct of other persons; my negligence and negligence of other persons including negligence on the part of the Releasees.
3. In consideration of my participation in the Activities, I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE Sporting Life Inc., Sporting Life Group Limited, Campfire Circle (formerly Camp Ooch & Camp Trillium Corporation), and their volunteers and employees, officers, directors, all sponsor and contributors, MAX VO2 Management Inc., Canada Running Series Inc., Canada Running Series Foundation and The Sporting Life 10K Organizing Committee (collectively, the “Event Organizers”), and the City of Toronto, The Toronto Board of Commissioners of Police, The Toronto Police, The Toronto Auxiliary Police Force, The Chief of Police, The Toronto Transit Commission, The Ministry of Transportation of Ontario, Board of Governors of Exhibition Place, Sidan Traffic Control Services, ASICS Canada Corporation, and all other associations, sanctioning bodies and sponsoring companies, and all of their respective employees, volunteers, directors, officers, board members, organizers, contractors, associates, representatives, sponsors, successors and assigns (collectively the “Releasees”) OF AND FROM ALL claims , demands, damages, costs, expenses, actions and causes of action, whether in law or equity in respect of death, injury, illness, virus contraction, loss or damage to my person or property HOWEVER CAUSED, arising or to arise by reason of my participation in the Activities, whether as a spectator, participant, volunteer or otherwise, AND NOTWITHSTANDING that same may have been contributed to, or occasioned by, the negligence of any of the aforesaid. I FURTHER HEREBY UNDERTAKE TO HOLD AND SAVE HARMLESS AND AGREE TO INDEMNIFY all of the Releasees from and against any and all liability incurred by all of them as a result of, or in any way connected with, my participation in the Activities. I WARRANT that I am physically fit to participate in the Activities.
4. Participants choosing to participate in the Activities do so at their own risk. By submitting this entry, I agree that I will conform to any and all directives, recommendations, mandates, or orders given by any local government or health authority in the specific location, and for the specific time, that I choose to participate in any of the Activities. I HEREBY ACKNOWLEDGE AND AGREE THAT THE EVENT ORGANIZERS TAKE NO RESPONSIBILITY WHATSOEVER FOR MONITORING THE DIRECTIVES, RECOMMENDATIONS, MANDATES, OR ORDERS OF GOVERNMENTS AND HEALTH AUTHORITIES AND ENSURING COMPLIANCE.
5. I HEREBY ACKNOWLEDGE AND AGREE THAT THE RELEASEES WILL NOT BE LIABLE IN ANY WAY IF I CONTRACT ANY ILLNESS (INCLUDING COVID-19) AS A RESULT OF PARTICIPATING IN ANY OF THE ACTIVITIES. Without limiting the generality of the foregoing, I acknowledge the following:
a. For my In-Person Event participation:
i. I acknowledge that other participants may carry contagious illnesses and I voluntarily assume the risk that I could be exposed to or infected by such illnesses, which are not monitored by the Event Organizers, by participating in the Activities. Being exposed to or infected by various illness may particularly lead to injuries, diseases, other illnesses or death.
ii. I agree to comply with all health and safety guidelines and requirements for the Event and the Activities which may be implemented by the Event Organizers.
iii. I acknowledge and accept that the Event and/or one or more Activities may be cancelled, the course and event structure altered and/or rescheduled as a result of matters beyond the control of the Event Organizers, including any endemic or pandemic.
iv. I confirm that the Event Organizers may disclose and/or provide my participant information to public health authorities for the purposes of contact tracing.
v. If I choose to push an infant in a stroller while completing my in-person Event, I’m familiar with and accept, on behalf of myself and my involuntary infant, that there is the risk of serious injury and death in participation with a stroller.
FOR VOLUNTEERS OF MINOR AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)
Additional Acknowledgment by Parent/Guardian
I am the parent/guardian of the minor child/ward (“Minor Child”) identified below having full legal responsibility for decisions regarding the Minor Child. I am familiar with and accept, on behalf of myself and my Minor Child that there is the risks, dangers and hazards associated with my Minor Child participating in the Activities as described above. I have satisfied myself and confirm that my Minor Child is of sufficient fitness and health (including, physical, mental and emotional) to participate in the Event. I understand, and will instruct my Minor Child, that all applicable rules for participation in the Event must be followed and that at all times the sole responsibility for personal safety of my Minor Child remains with myself and my Minor Child. I hereby agree to the terms of this Waiver Agreement for and on behalf of my Minor Child.
GENERAL TERMS
This Waiver Agreement and any rights, duties and obligations as between the parties to this Waiver Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario and no other jurisdiction; and any litigation involving the parties to this Waiver Agreement shall be brought solely within the Province of Ontario and shall be within the exclusive jurisdiction of the courts of the Province of Ontario.
If any provision of this Waiver Agreement or portion thereof or the application thereof to any person or circumstance shall to any extent be illegal, invalid or unenforceable: (a) the remainder of this Waiver Agreement or the application of such provision or portion thereof to any other person or circumstance shall not be affected thereby; and (b) the parties will negotiate in good faith to amend this Waiver Agreement to implement the intentions set forth in this Waiver Agreement. Each provision of this Waiver Agreement shall be legal, valid and enforceable to the fullest extent permitted by law.
I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THIS WAIVER AGREEMENT AND I FULLY UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS (INCLUDING ON BEHALF OF MY MINOR CHILD, AS APPLICABLE) BY SIGNING THIS WAIVER AGREEMENT, INCLUDING THE RIGHT TO SUE. I CONFIRM THAT I (INCLUDING ON BEHALF OF MY MINOR CHILD, AS APPLICABLE) HAVE AGREED TO THE TERMS OF THIS WAIVER AGREEMENT FREELY AND VOLUNTARILY.
