Waiver
Release Waiver And Indemnity
In consideration of Canada Running Series Inc. accepting my entry in this running event as Volunteer (hereinafter “the Event”), I, the below undersigned, intending to be legally bound, for myself, my heirs, my executors and administrators, agree as follows:
AS A CONDITION of my participation in the Event, I ASSUME ALL RISK of personal injury, death, or property loss resulting from any cause whatsoever, including, but not limited to, the negligence, gross negligence, breach of contract or breach of statutory duty of care on the part of Canada Running Series Inc., Canada Running Series Foundation, The Toronto Police Services, The Toronto Police Services Board, The Chief of Police, The City of Toronto, Odyssey Medical Inc., The Corporation of the City of Toronto, Beneva Inc., Columbia Sportswear Company, Organika, Inc., A. Lassonde Inc., Made with Local Snack Foods Inc., Green Event Ninjas, The Running Physio, High Park Initiatives, NUUN & Co Inc., General Mills Canada Corporation, Fast North Corp. (Race Roster), Sports Technology and Timing Systems Limited (Sportstats), it’s employees, volunteers, organizers, contractors, associates, representatives, sponsors, successors and assigns (collectively the “Canada Running Series Group”).
I AGREE that the Canada Running Series Group shall NOT BE LIABLE for any such personal injury, death or property loss as a result of my participation in the Event as Volunteer and I release Canada Running Series Group and WAIVE ALL MY RIGHTS and CLAIMS with respect thereto.
I AGREE NOT TO SUE the Canada Running Series Group for any loss, injury, costs or damages of any form or types, howsoever caused or arising, and whether directly or indirectly from my participation in the Event as Volunteer.
I AGREE TO INDEMNIFY and to SAVE and HOLD HARMLESS the Canada Running Series Group and each of them, from any litigation expense, legal fees, liability, damage, award or cost, of any form or type whatsoever, they may incur due to any claim made against them, or any of them, as a result of my participation in the Event as Volunteer whether the claim is based on the negligence or gross negligence of the Canada Running Series Group or otherwise.
I acknowledge the following for my volunteer participation:
I acknowledge the highly contagious nature of COVID-19 and I voluntarily assume the risk that I could be exposed to or infected by COVID-19 by participating in this running event as Volunteer. Being exposed to or infected by COVID-19 may particularly lead to injuries, diseases or other illnesses.
I agree to comply with all health and safety guidelines and requirements for this running event which may be implemented by Canada Running Series Inc.
I acknowledge and accept that this running event may be cancelled and/or rescheduled as a result of the ongoing impact of COVID-19.
I confirm that Canada Running Series may disclose and/or provide my participant information to public health authorities for the purposes of contact tracing.
I attest that I am physically fit for the completion of the Event. Furthermore, I hereby grant full permission to use my name and likeliness, as well as any photographs and any record of the Event in which I may appear for legitimate purpose, including advertising and promotion.
I understand that if I select to donate to or fundraise for one of the participating official charities, they may contact me with more information on fundraising and race participation at Canada Running Series events.
Canada Running Series is committed to fostering an equitable and inclusive global running community to promote accessible running for all. We celebrate and welcome the diversity of all employees, stakeholders, event staff, volunteers, and participants. It is the policy of Canada Running Series, and by extension, its participants, to foster an environment that respects people's dignity, ideas and beliefs thereby ensuring a safe, comfortable, and supportive environment free from discrimination, harassment and hate. Violation of this policy will lead to the review of your continued participation as Volunteer and may result in immediate removal from the event. By agreeing to the the zero tolerance policy, you acknowledge your commitment to upholding Canada Running Series’ inclusion policy.
I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY AGREEING TO THIS WAIVER AGREEMENT I AM GIVING UP CERTAIN SUBSTANTIAL LEGAL RIGHTS INCLUDING THE RIGHT TO SUE.
FOR PARTICIPANTS OF MINOR AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)
ACKNOWLEDGMENT BY PARENT/GUARDIAN
I am the parent/guardian of the minor child/ward (hereinafter “Minor Child”) identified above having full legal responsibility for decisions regarding my Minor Child; and
I’m familiar with and accept, on behalf of myself and my Minor Child that there is the risk of serious injury and death in participation as volunteer; and I have satisfied myself and believe that my Minor Child is physically, emotionally and mentally able to participate in the Event as Volunteer; and
I understand, and will instruct my Minor Child, that all applicable rules for participation in the Event must be followed and that at all times the sole responsibility for personal safety of my Minor Child remains with myself and my Minor Child.
I have read this Acknowledgment, Assumption of Risk and Release of Liability thoroughly and I understand all of the terms. I, on behalf of myself and my Minor Child, agree to be bound by all the terms of this Acknowledgement, Assumption of Risk and Release of Liability agreement in connection with my Minor Child’s participation in the Event as Volunteer. If, despite this agreement, I, or anyone on the minor’s behalf, makes a claim for Liability against Canada Running Series Inc., or any one of them, I will indemnify, defend and hold harmless each of the from any such Liability which any may be incurred as the result of such claim as a result of my participation in the Event as Volunteer whether the claim is based on the negligence or gross negligence of Canada Running Series Inc., or otherwise.
