Waiver
In consideration of Canada Running Series Inc. accepting my entry in this running event as a Volunteer (hereinafter “the Event”), I, the below undersigned, intending to be legally bound, for myself, my heirs, my executors and administrators, agree as follows:
AS A CONDITION of my participation in the Event as a Volunteer, I ASSUME ALL RISK of personal injury, death, or property loss resulting from any cause whatsoever, including, but not limited to, the negligence, gross negligence, breach of contract or breach of statutory duty of care on the part of Canada Running Series Inc., Canada Running Series Foundation, Athletics Canada, BC Athletics, The City of Vancouver, Vancouver Parks Board, BC Ministry of Health Services/BC Ambulance, Vancouver Police Department, Fast North Corp. (Race Roster), Sports Technology and Timing Systems Limited (Sportstats), Odyssey Medical Inc., His Majesty the King in Right of the Province of British Columbia as requested by the Minister of Transportation together with the employees, agents and servants of the Minister, South Coast British Columbia Transportation Authority, Westbank Corp., Under Armour Inc., Vancouver Coastal Health, BCRS Road Safe Inc., Nuun & Company, Inc., General Mills Canada Corporation, Organika Inc., PHS Community Services Society, Downtown Eastside Women’s Centre, Urban Native Youth Association, Kidsport BC, its employees, volunteers, organizers, contractors, associates, representatives, sponsors, successors and assigns (collectively the “Canada Running Series Group”).
I AGREE that the Canada Running Series Group shall NOT BE LIABLE for any such personal injury, death or property loss as a result of my participation in the Event and I release Canada Running Series Group and WAIVE ALL MY RIGHTS and CLAIMS with respect thereto.
I AGREE NOT TO SUE the Canada Running Series Group for any loss, injury, costs or damages of any form or types, howsoever caused or arising, and whether directly or indirectly from my participation in the Event.
I AGREE TO INDEMNIFY and to SAVE and HOLD HARMLESS the Canada Running Series Group and each of them, from any litigation expense, legal fees, liability, damage, award or cost, of any form or type whatsoever, they may incur due to any claim made against them, or any of them, as a result of my participation in the Event whether the claim is based on the negligence or gross negligence of the Canada Running Series Group or otherwise.
I acknowledge the following for my in-person volunteer participation:
• I acknowledge the highly contagious nature of COVID-19 and I voluntarily assume the risk that I could be exposed to or infected by COVID-19 by participating in this running event. Being exposed to or infected by COVID-19 may particularly lead to injuries, diseases or other illnesses.
• I agree to comply with all health and safety guidelines and requirements for this running event which may be implemented by Canada Running Series Inc.
• I understand that if I am experiencing symptoms of COVID-19 on race day or other days I am assigned to work I must stay at home.
• I acknowledge and accept that this running event may be cancelled and/or rescheduled as a result of the ongoing impact of COVID-19.
• I confirm that Canada Running Series may disclose and/or provide my information to public health authorities for the purposes of contact tracing.
I attest that I am healthy and able to complete my responsibilities as outlined in my job description.
Furthermore, I hereby grant full permission to use my name and likeliness, as well as any photographs and any record of the Event in which I may appear for legitimate purpose, including advertising and promotion.
I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY AGREEING TO THIS WAIVER AGREEMENT I AM GIVING UP CERTAIN SUBSTANTIAL LEGAL RIGHTS INCLUDING THE RIGHT TO SUE. THIS EVENT IS GOVERNED BY THE LAWS OF BRITISH COLUMBIA.
Canada Running Series is committed to fostering an equitable and inclusive global running community to promote accessible running for all. We celebrate and welcome the diversity of all employees, stakeholders, event staff, volunteers, and participants. It is the policy of Canada Running Series, and by extension, its volunteers, to foster an environment that respects people's dignity, ideas and beliefs thereby ensuring a safe, comfortable, and supportive environment free from discrimination, harassment and hate. Violation of this policy will lead to the review of your continued participation and may result in the immediate termination of your role.
By agreeing to the Volunteer Waiver, you acknowledge your commitment to upholding Canada Running Series’ inclusion policy.
